Truki Terms of Service

These Terms of Service (“Terms”) are an agreement between you and Lewis Paine, trading as Truki. They govern your use of the Truki app, our website at truki.co.uk, any beta or test versions, and related services (together, “Truki” or “the Service”).

By downloading, accessing or using Truki, you agree to these Terms. If you do not agree, please do not use the Service. If you buy a subscription, the Truki Pro subscriptions section also applies. Your privacy is covered by our Privacy Policy. We suggest you save or print a copy of these Terms for your records.

1. About these Terms

These Terms apply to the Truki app, the Truki website, any beta, preview or TestFlight versions, and any related services we provide. By using Truki you confirm that you accept these Terms and that you are able to enter into a binding agreement.

Where you buy Truki Pro, the additional terms in the Truki Pro subscriptions section also apply. If there is any conflict between those subscription terms and the rest of these Terms, the subscription terms apply to your subscription.

2. About Truki

Truki is a navigation and route-planning support tool designed for HGV and professional drivers. It offers HGV-aware routing, vehicle profiles, multi-drop planning and live traffic and incident information.

Truki is continually developed and improved. Features, coverage, data and availability may be added, changed or removed through updates over time as we improve the product.

Beta and TestFlight versions. If you use a beta, preview or TestFlight version of Truki, it is a test version and may contain unfinished features, faults, inaccuracies or interruptions. You should not rely on a test version for real journeys in the same way as the released app.

3. Where you can use Truki

Truki is currently designed and supported for use within the United Kingdom only.

Support for Europe and other regions is not currently available. You must not rely on Truki for routing, restrictions or navigation outside supported areas. If you travel outside the UK, please use official local navigation, mapping and road signage instead.

4. Navigation and safety

Truki is a support tool to help you plan and follow routes. It does not replace your responsibility to drive safely and legally, and it is not an official authority or a guaranteed compliance tool. In particular:

• Road signs always override Truki.
• Instructions from the police and official traffic controls always override Truki.
• You must always use your own professional judgement.
• You must not use Truki as the only way to decide whether a road is legal or suitable for your vehicle.
• You remain responsible for the safe and legal operation of your vehicle at all times.
• Truki does not guarantee that any route is suitable for a particular vehicle, trailer, load or delivery.

Please set up your route before you set off, do not interact with the app in a way that distracts you while driving, and always follow the Highway Code and applicable law.

5. Your vehicle information

Truki uses the vehicle details you enter to plan routes and show warnings. You are responsible for entering accurate and complete vehicle information, including, where relevant:

• Vehicle height
• Width
• Length
• Gross weight
• Axle weight
• Trailer dimensions
• Load dimensions
• Any hazardous or abnormal-load information

If the details you enter are inaccurate, incomplete or out of date, Truki may produce unsuitable routes or may not warn you about a restriction. Please check and update your vehicle profile whenever your vehicle, trailer or load changes.

6. Restriction and map data

Truki uses map and restriction data to plan routes and display warnings. Depending on the area and feature, this may include information about:

• Bridge heights
• Weight restrictions
• Width restrictions
• HGV restrictions
• Toll roads
• Motorway avoidance
• Traffic incidents
• Road closures
• Roadworks
• Speed limits
• Temporary restrictions

This data may be incomplete, inaccurate, delayed or out of date. Some of it comes from OpenStreetMap and other third-party sources and may not have been independently verified by Truki. Always confirm restrictions against the road signs and conditions in front of you.

7. Third-party providers

Truki relies on third-party services to work. Depending on the feature, these may include:

• TomTom
• Apple services
• OpenStreetMap
• National Highways
• Other mapping, traffic, hosting and data providers

We do not control the availability, accuracy or service changes of these providers, and we are not responsible for their outages, errors or changes. Truki does not own the underlying third-party maps or road data — these remain the property of their respective owners and are used under their terms.

8. Truki Pro subscriptions

Some features are offered through a paid subscription called Truki Pro.

• Plans. Truki Pro is available on a monthly or annual basis.
• Price. The price and billing period are shown to you before you confirm a purchase. Prices may vary by country or App Store region.
• Payment. Purchases made through the iOS app are charged to your Apple Account.
• Automatic renewal. Subscriptions renew automatically for the same period unless you cancel.
• Renewal charge. Your Apple Account is charged for renewal within the renewal window stated by Apple (normally within the 24 hours before the current period ends).
• Free trials and offers. We may offer a free trial or promotional offer.
• Trials converting to paid. Unless you cancel before the trial or offer ends, it will automatically convert to a paid subscription at the applicable price.
• Managing your subscription. You can view, change or cancel your subscription in your Apple Account settings.
• Cancellation. If you cancel, cancellation takes effect at the end of the current billing period, and you keep access to Pro features until then.
• Restore Purchases. If you reinstall the app or change device, you can use “Restore Purchases” to restore an active subscription.
• Refunds. Where a purchase was made through Apple, refund requests are handled by Apple under its terms. We may not be able to issue refunds for Apple purchases directly.
• End of access. Access to Pro features ends when your subscription expires or is cancelled and the paid period finishes.
• Price changes. Any changes to subscription prices are handled in line with Apple’s rules and applicable law. Where required, you will be asked to agree, or given the chance to cancel, before a price increase takes effect.

This section does not affect your consumer rights.

9. Your consumer rights

Nothing in these Terms removes or limits any rights you have under applicable UK consumer law that cannot be excluded. If any part of these Terms conflicts with rights you have under that law, those statutory rights apply.

10. Our responsibility to you

We take reasonable care to provide Truki, but it is a support tool and we cannot guarantee that it is always accurate, error-free or uninterrupted. This section explains what we are and are not responsible for. Nothing in this section affects the rights described in Your consumer rights.

We are not responsible for loss or damage that is caused by:

• vehicle information you entered incorrectly or incompletely;
• you ignoring road signs, police instructions or official traffic controls;
• errors, omissions or delays in third-party data or services.

To the extent permitted by law, we are not liable for losses that are indirect, or that were not reasonably foreseeable at the time you used the Service. If you use Truki wholly or mainly for your business, we are not liable to you for business losses such as loss of profit, loss of contracts, missed deliveries, or business interruption.

Where we are liable to you as a consumer, we are responsible for foreseeable loss or damage caused by us failing to use reasonable care and skill, but we are not responsible for things outside our reasonable control.

We do not exclude or limit our liability for:

• death or personal injury caused by our negligence;
• fraud or fraudulent misrepresentation;
• any other liability that cannot legally be excluded or limited.

Truki does not claim to be immune from all accidents, vehicle damage or fines. Responsibility for those depends on the circumstances and on your own compliance with the law and these Terms.

11. Accounts and security

Some features need an account or sign-in (for example signing in with your Apple Account and iCloud). Where you use these features, you are responsible for:

• keeping your login details and device secure;
• your saved locations, vehicle profiles and synced data;
• activity that takes place under your account.

You can request deletion of your account and associated data as described in our Privacy Policy. We may suspend or close an account where we reasonably believe it is being misused or these Terms have been breached. How we handle your personal data is explained in our Privacy Policy.

12. Privacy

Your privacy matters to us. Location data, account information and other personal data are handled in line with our Privacy Policy (https://www.truki.co.uk/privacy). Please read it to understand how your information is used. We do not repeat the full Privacy Policy here.

13. Acceptable use

You agree not to:

• use Truki for any illegal purpose;
• use Truki in an unsafe way, or interact with it in a way that distracts you while driving;
• reverse engineer, decompile or attempt to extract source code, except where the law allows;
• use automated tools to scrape, copy or harvest data from the Service;
• attempt to bypass, disable or interfere with subscription or payment controls;
• misuse or overload our APIs, or interfere with our systems, the Service or other users;
• use Truki, or data from it, to create or populate a competing commercial database or product;
• share an account in a way that breaches the subscription rules;
• misrepresent Truki as an official authority or a guaranteed compliance tool.

We may suspend or end your access where we reasonably believe you have breached this section.

14. Service availability

We aim to keep Truki available, but we cannot promise that it will always be uninterrupted or fault-free. The Service may be affected by:

• maintenance;
• outages;
• GPS or satellite-signal failures;
• internet or mobile-data problems;
• third-party service failures;
• device or operating-system compatibility issues.

Where we make changes, we will not remove paid features you are entitled to without respecting your active subscription and your consumer rights.

15. Changes to the Service

Truki is developed over time. We may update, add, replace or remove features as the product develops. Where a change is material and affects you, we will give reasonable notice where we are required to do so, and we will respect active subscriptions and your consumer rights.

16. Changes to these Terms

We may update these Terms from time to time — for example, to reflect new features, legal requirements or changes to how the Service works. The “Last updated” date at the top shows when we last made changes.

For material changes, we will take reasonable steps to let you know, for example through the app, the website or by email where appropriate. Continuing to use Truki after changes take effect will normally mean you accept the updated Terms, but this does not remove any rights you have where your specific agreement to a change is required by law.

17. Intellectual property

• Truki branding and software. The Truki name, logo, app, website and original content are owned by us or our licensors. You are given a limited, personal, non-exclusive, revocable licence to use Truki for its intended purpose. You must not copy, resell or commercially exploit it except as allowed by these Terms or the law.
• Third-party maps and data. Mapping and road data from providers such as TomTom, OpenStreetMap and National Highways remain the property of those providers and are used under their terms. We do not own or claim ownership of that data.
• Open-source components. Truki may include open-source software, which remains subject to its own licences.
• Your feedback. If you send us feedback or suggestions, you allow us to use it to operate, improve and develop Truki, without obligation to you and subject to our Privacy Policy.

18. Governing law

These Terms, and any dispute relating to them, are governed by the law of England and Wales, and the courts of England and Wales will have jurisdiction. If you live in another part of the UK, or in another country, you may still have mandatory rights under the law of the place where you live, and nothing in these Terms affects those rights.

19. Apple’s terms

If you download or buy Truki, or a subscription, through the App Store, your use is also subject to Apple’s standard End User Licence Agreement (EULA) and Apple Media Services Terms and Conditions. Those Apple terms apply in addition to these Terms for the iOS app — these Terms do not replace Apple’s EULA.
